Construction machinery is not subject to road registration requirements like passenger cars and therefore falls under a different legal framework. Individual ECU calibration is generally permissible. For commercially used machines, it is advisable to check with the machinery insurer — in practice, no problems arise with professionally carried out work.
For new machines with an active factory warranty, the manufacturer may investigate whether any fault is related to the ECU change. Since the original file can be restored without trace at any time, this can be managed in practice. For machines without an active manufacturer warranty, this is not an issue.
